The major governing documents for the Marquesa at Monarch Beach Homeowners Association, in precedence order are: Article of Incorporation, CC&Rs, Bylaws, Rules and Regulations. The Design Guidelines provide and define the community architectural criteria. The series of easement documents define the slopes of our community and provide the Homeowner's Association (HOA) easements on, over and under the slopes. The HOA is to provide landscaping, drainage and erosion control as specified in the easements and our CC&Rs. A shared facilities use and maintenance agreement provides a nonexclusive easement for Montego residents to enter and exit their property.
