The major governing documents for the Marquesa at Monarch Beach Homeowners Association (HOA), in precedence order are: Article of Incorporation, The Declaration of Covenants, Conditions and Restrictions (CC&Rs), Bylaws, Rules and Regulations. The Design Guidelines provide and define the community architectural criteria. The series of easement documents define the slopes of our community and provide the HOA easements on, over and under the slopes.  The HOA is to provide landscaping, drainage and erosion control as specified in the easement documents and our CC&Rs. A shared facilities use and maintenance agreement provides a nonexclusive easement for Montego residents to enter and exit their property.
